- The client explicitly waives its own standard terms and conditions, even if these were drawn up after these standard terms and conditions of sale. In order to be valid, any derogation must be expressly agreed to in advance in writing.
- Our invoices are payable the same day, unless another payment timeframe is indicated on either the invoice or the order. In the event of non-payment by the due date, Every Mile Gifts reserves the right to request a fixed interest payment amounting to 10% of the sum remaining due. Every Mile Gifts will be authorized to suspend any provision of services without prior warning in the event of late payment.
- If a payment is still outstanding more than seven (7) days after the due payment date, Every Mile Gifts reserves the right to call on the services of a debt recovery company. All legal expenses and any fees related to the recovery of the outstanding amount will be payable by the client.
- Certain countries apply withholding at source on the amount of invoices, in accordance with their internal legislation. Any withholding at source will be paid by the client to the tax authorities. Under no circumstances will Every Mile Gifts be involved in any costs related to a country's legislation. The full amount of the invoice will therefore be due to Every Mile Gifts and does not include any costs or deductions related to the legislation of the country in which the client is located.
- Every Mile Gifts undertakes to do its best to supply performant services in due time in accordance with the agreed timeframes. However, none of its obligations can be considered as an obligation to achieve specific results. Under no circumstances will Every Mile Gifts be held liable for any indirect or consequential losses or damages. Furthermore, Every Mile Gifts cannot under any circumstances be required by the client to appear as a third party in the context of any claim for damages filed against the client by an end consumer or any third party.
- In the event that Every Mile Gifts is unable to fulfill its obligations due to an event outside its reasonable control, including but not limited to acts of God, government restrictions, natural disasters, pandemics, or supply chain disruptions, Every Mile Gifts shall not be liable for any delay or failure to perform. Such events shall constitute force majeure.
- In order for it to be admissible, Every Mile Gifts must be notified of any claim by means of a letter sent by recorded delivery to its registered office and via email within five (5) days of the delivery of the goods or the provision of the services. Failure to provide timely notification shall result in the claim being deemed waived by the client.
- In the event of any dispute or legal proceedings between Every Mile Gifts and the client, the liability of Every Mile Gifts shall be limited to the amount of the invoice(s) in question. Under no circumstances shall the personal assets of the partners of Every Mile Gifts be subject to claims, except in cases of proven fraud or gross negligence.
- Every effort is made to accurately describe the products contained in our gift baskets. However, due to product availability or seasonal changes, substitutions of equal or greater value may be made without notice. Every Mile Gifts will ensure that the substituted items are of a similar nature and quality to those originally listed.
- Every Mile Gifts takes great care in selecting the products for its gift baskets. However, many items may contain or be produced in facilities that process common allergens, including but not limited to nuts, dairy, gluten, and soy. The client acknowledges and accepts full responsibility for verifying all ingredients before consumption. Every Mile Gifts shall not be liable for any allergic reactions or health issues arising from the consumption of items in the gift baskets.
- Gift baskets containing perishable items must be opened and refrigerated upon receipt. Every Mile Gifts is not responsible for the condition of perishable items if delivery is delayed or if the recipient fails to promptly accept and properly store the items upon delivery. All delivery timeframes are estimates and subject to change due to external factors.
- Due to the nature of our products, Every Mile Gifts does not accept returns on any food items or opened gift baskets. In the unlikely event that any product arrives damaged or defective, please notify us within 24 hours of receipt, and we will provide a replacement or refund at our discretion.
- Custom or personalized gift baskets cannot be canceled once the order is confirmed. All sales on custom orders are final. Any request for changes must be made within 24 hours of order placement and is subject to approval.
- Every Mile Gifts is not responsible for the quality or condition of perishable goods once they have been delivered and accepted by the client or recipient. All claims related to the condition of perishable goods must be made within 24 hours of receipt.
- All intellectual property, including trademarks, logos, content, and designs provided by Every Mile Gifts, remain the property of Every Mile Gifts unless otherwise agreed in writing. Unauthorized use, reproduction, or distribution is strictly prohibited and will be subject to legal action.
- All our contractual relations will be governed exclusively by Canadian law. Any dispute arising from or related to these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Ontario, Canada.
- These terms and conditions, along with any written agreements entered into between Every Mile Gifts and the client, constitute the entire agreement between the parties. No oral or implied agreements shall be binding unless specifically agreed to in writing. In the event any provision of these terms and conditions is found to be unenforceable, the remaining provisions shall remain in full force and effect.

Our delivery policies include:
- Delivery Options: We offer a variety of delivery options to suit your needs.
- Late Delivery: If your order is delayed, we will keep you informed and work to resolve the issue.
- Address Errors & Recipient Not Home: Please ensure that delivery information is accurate. If an address error occurs or the recipient is unavailable, we will make every effort to re-deliver, though surcharges may apply.
- Holiday Surcharges: Additional fees may be applied for deliveries on holidays and special occasions. Any orders processed in the month of December will be subject to a $25 shipping charge. During holidays (Valentine's, Mother's Day, Christmas, New Year) delivery may occur up until 9:00 pm. We cannot guarantee specific delivery times during peak holidays.
- Same Day Delivery Policies: Specific terms apply for same-day, so please check at the time of ordering. Same-day delivery fee is $25 dollars. Same day delivery is subject to the availability of products at the time your order is processed. Please note that while our website may display certain items as available, they may not be accessible for order fulfillment. Same Day delivery services are exclusively available within the Greater Toronto Area. Deliveries to business locations will be completed by 5 p.m., while residential deliveries will occur by 8 p.m. To ensure eligibility, orders must be submitted prior to 11 a.m. local time on the same day or earlier.
Shipping Locations
We currently offer shipping within Canada. If you require international shipping, please contact us for availability and special arrangements.
Processing Time
All orders are processed within 1-3 business days. Orders are not shipped or delivered on weekends or holidays. If we experience a high volume of orders, processing may take slightly longer, but we will notify you of any significant delays.
Shipping Methods & Delivery Time
We ship our products with utmost care, and most of our products are hand-delivered. We also partner with reliable courier services such as UPS to ensure prompt and safe delivery of your gifts. Estimated delivery times vary based on the destination:
- Local (within GTA): 3-5 business days
- National (across Canada): 3-7 business days
- Same Day/Expedited Shipping: Available for an additional fee (1-2 business days)
Please note that delivery delays may occur due to unforeseen circumstances, such as weather, holidays, or customs processing for international orders.
Standard Shipping Rates
We like to provide you with a standard shipping charge of $15 for local (within GTA) deliveries so that our customers get a better estimate of their orders. One other benefit you get from us is that our shipping remains the same even for larger/heavier orders as long as it can be delivered in one trip because most of the orders are hand-delivered. You will be able to view the shipping cost at checkout before completing your order for GTA orders. For orders outside GTA, contact us for more accurate shipping.
Order Tracking
Once your order has been placed, you will receive a confirmation email with an additional email when it is out for delivery.
Customs, Duties, and Taxes
For international orders, the recipient may be subject to import duties, taxes, or fees levied by the destination country. These additional charges are the responsibility of the recipient and are not included in our shipping fee. We recommend contacting your local customs office for more information.
Delivery Issues
If no individual is available to receive the order at the designated location, our driver will utilize their judgment, taking into account factors such as weather conditions, safety, and security. Please be advised that a re-delivery fee of $14.99 will apply in such cases. Kindly be advised that our couriers do not contact recipients prior to delivery. We recommend ensuring that someone is present to receive the items. Please note that a re-delivery fee of $14.99 will be incurred if the delivery cannot be completed.
If your order arrives damaged or is lost in transit, please contact us immediately at Everymilegifts@gmail.com with your order number. We will work to resolve the issue promptly. For damaged goods, please provide photos and details within 24 hours of receiving the package.
Incorrect Addresses
Please ensure the shipping address provided is correct. We are not responsible for orders delivered to incorrect addresses due to inaccurate information provided at checkout. Incomplete order: Orders received with insufficient delivery information will be temporarily held until the necessary details are provided. In the event that the selected delivery date is no longer accessible, your order will be rescheduled to the next available date at the time of order finalization. Please note that refunds for incomplete orders cannot be accommodated. We will either fulfill your order on the next available delivery date or issue a store credit* for future transactions.
Disclaimer:
Every Mile Gifts disclaims any responsibility for delivery delays resulting from unforeseen events, including but not limited to natural disasters such as storms, hurricanes, or earthquakes. Consequently, no refunds will be issued under these circumstances.
Please note that Sunday delivery is not available outside of our Same Day Delivery zones, with the exceptions of Valentine's Day and Mother's Day. Additionally, we do not provide delivery services on statutory holidays, which include New Year's Day, Easter, Victoria Day, Canada Day, Labour Day, Thanksgiving, Christmas, Boxing Day, and St. Jean Baptiste Day.
Surcharges for Same Day and holiday deliveries will apply. We encourage you to review all available delivery options during the checkout process, especially during high-demand periods.
Every Mile Gifts cannot be held liable for orders left at the door that are subsequently stolen or damaged.
Furthermore, Every Mile Gifts is not responsible for delays incurred by third-party couriers, including Purolator, FedEx, Dicom, UPS and Canada Post.
Please ensure that you provide a physical address, as we are unable to deliver to PO Boxes.

Order & Cancelation Policy
All modifications and updates to your order must be executed within two(2) hours of placement. Please note that orders designated for Same Day Delivery or Next Day Delivery are not eligible for amendments or cancellations. We are unable to process cancellations for any order that has already been prepared or is currently in transit with the courier. We kindly ask that you verify all information in your order prior to submission.
Requests for changes submitted after this two (2) hours window are not guaranteed to be accommodated. Furthermore, all orders placed during peak holiday periods (including but not limited to Valentine's Day, Mother's Day, and Christmas) are considered final.
During peak holiday seasons, it is particularly challenging to implement changes to existing orders. While we will make every effort to assist you, please be aware that such requests may not be fulfilled.

Due to our order volume fluctuation, we reserve the right to substitute with similar product of equal or greater value.
You will be happy to know that our substitution rate last year was 1.5%.

Gourmet Gifts & Specialty Items (including, but not limited to, Fruit and Gift Baskets, Cookies, Cakes, Chocolates, Teddy Bears, Balloons, and Vases): These items may be substituted with another specialty item of equal or greater value and of similar theme and category.
